Position Description:
Become a part of the Department that touches the lives of every American! Join HHS/FDA/Center for Tobacco Products (CTP) and help to make our world healthier, safer and better for all Americans. CTP is the newest arm of the FDA. CTP is the principal Federal agency charged to establish tobacco product regulations in order to decrease the tremendous toll of disease, disability and death caused by tobacco use in the United States. FDA tobacco product regulations will be based on the best available science and FDA's CTP will be responsible to both assess and foster that science.

MAJOR DUTIES:

This position is a Senior Contract Specialist and leading expert on contracting and simplified acquisition for R&D, A/E, Facilities, Support, Studies, and Service Contracts for the FDA.

If selected for this position, you will:

- Serve as a Contract Specialist responsible for pre-award and post- award contract functions including negotiation, cost/price analysis, and administration of contracts for services, construction, architect-engineering services, information technology, equipment and/or commodities;

- Address problems that have arisen, present alternative solutions, and negotiate with the contractor to settle issues that affect the terms and conditions of the award;

- Review settlement proposals. Recommend decisions on unsettled claims arising under termination actions;

- Develop plans with program officials to effectively and efficiently provide contract management support. Advise program office staff with regard to the acquisition objective, plan strategies pertaining to the degree of competition, the contractual methods and vehicle to be employed to meet program objectives and policy/regulatory requirements, timing of events and similar considerations;

- Prepare, coordinate and maintain current acquisition plans, appropriate milestone charts and related schedules. Prepare synopsis of request for proposals and contract awards for publishing on FedBizOpps.gov. Prepare solicitation documents for procurement actions. Incorporate the required Federal Acquisition Regulation, Health and Human Services Acquisition Regulation, Code of Federal Regulations and other governmental regulations and policies. Release the solicitation and receive offers in response;

- Assure receipt of proposals, adhere to the required time limit and ensure proposals are handled properly. Analyze proposals for conformance with the solicitation. Perform cost/price analysis, including review of cost breakdowns to determine reasonableness and conformance to applicable regulations, directives or policies. Coordinate the establishment of a technical evaluation panel to review and score the technical proposals. Attend the technical evaluation panel review meeting to monitor the process for adherence to established regulations and policies;

- Establish the competitive range for contract proposals based on price and technical factors. Obtain pre-award surveys to establish business/financial management capability. Obtain audits as necessary. Serve as lead negotiator conducting negotiations with offers within the competitive range;

- Plan the negotiation strategy, coordinate the strategy with the negotiating team which includes program officials, contracting officials, attorneys, and/or cost analyst;

- Award contracts within designated limits or recommend award to the contracting officer. Prepare contract award document and all necessary contract file documentation for contract awards. Prepare position on protests or appeals, if necessary;

- Develop within the legal and regulatory framework, procurement procedures and operating instructions tailored to meet the specific needs of the procuring office;

- Provide technical guidance to junior and senior contract specialists on all aspects of pre- and post-award acquisitions and contract activities. Serve as a resource for other specialists on contracting and acquisition policies and procedures, provide necessary on-the-job training, and assist specialist in dealing with various government personnel, contractors, and others from the public; and

- Represent supervisor in meetings and in the absence of the supervisor serves in that position.

QUALIFICATIONS REQUIRED:

GS-14: You must complete all mandatory training prescribed by the head of the agency and possess 4 years of experience in contracting or related positions. At least 1 year of that experience must have been specialized experience at or equivalent to the GS-13 level. This experience must have equipped you with the skills needed to perform the job duties. Examples include responsibility for a range of contract specializations such as negotiation, cost and price analysis, and administration. You must also have successfully completed a 4-year course of study leading to a bachelor's degree, that included or was supplemented by at least 24 semester hours in any combination of the following fields: accounting, business, finance, law, contracts, purchasing, economics, industrial management, marketing, quantitative methods, or organization and management. Basic Requirements for GS-14

A. Completion of all mandatory training prescribed by the head of the agency for progression to GS-13 or higher level contracting positions, including at least 4-years experience in contracting or related positions. At least 1 year of that experience must have been specialized experience at or equivalent to work at the next lower level of the position, and must have provided the knowledge, skills, and abilities to perform successfully the work of the position.

AND

B. A 4-year course of study leading to a bachelor's degree, that included or was supplemented by at least 24 semester hours in any combination of the following fields: accounting, business, finance, law, contracts, purchasing, economics, industrial management, marketing, quantitative methods, or organization and management.

C. Exceptions: Employees in GS-1102 positions will be considered to have met the standard for positions they occupy on January 1, 2000. This also applies to positions at the same grade in the same agency or other agencies if the specialized experience requirements are met. However, they will have to meet the basic requirements and specialized experience requirements in order to qualify for promotion to a higher grade, unless granted a waiver under Paragraph D.

D. Waiver: When filling a specific vacant position, the senior procurement executive of the selecting agency, at his or her discretion, may waive any or all of the requirements of Paragraphs A and B above if the senior procurement executive certifies that the applicant possesses significant potential for advancement to levels of greater responsibility and authority, based on demonstrated analytical and decision making capabilities, job performance, and qualifying experience. With respect to each waiver granted under this Paragraph D, the senior procurement executive must document for the record the basis of the waiver. If an individual is placed in a position in an agency on the basis of a waiver, the agency may later reassign that individual to another position at the same grade within that agency without additional waiver action.
